On December 12, 2016, Politico reported that the European Commission intends to replace the e-Privacy Directive with a Regulation. The draft Regulation is intended to complement the EU GDPR, and contains a number of provisions that mirror those of the GDPR.

Technological advances and the advent of the EU General Data Protection Regulation (“GDPR”) have prompted the European Commission to review the e-Privacy Directive, which was last updated in 2009. The reform of the e-Privacy rules was discussed at a stakeholder workshop organized by the European Commission in Brussels on April 12.
