Choice should be presented in a short and concise manner at the point of collection. Once consumers exercise choice, it must be respected. Consumer and business education is a critical issue. The FTC is seeking comments, which are due January 31, 2011. Data brokers will continue to be in the spotlight.

The stakes are high, not least because the introduction of greater friction in data transfers could present a real barrier to future trade. Withdrawal from the EU means that we stand to lose the institutional platform from which we have exercised that influence. It seems odd to have more clarity post Brexit than pre-Brexit.
